The following paragraphs discuss Customs valuation procedures that are applicable to determining the value on which the GST is to be calculated pursuant to Division III of Part IX of the Act. Importers who are registered for purposes of the GST should use the Canada Customs Adjustment Request (FormB-2) to recover overpaid customs duties and excise taxes. While the regulations made under section 8 of Schedule VII to the Act have not yet been finalized, the following is a draft of these regulations as issued by the Department of Finance: (a) precious metals imported under any circumstances; (b) unwrought silver, gold or platinum, waste and scrap of precious metal or of metal clad with precious metal, and concentrates of silver, gold or platinum where imported for the purpose of being refined into precious metals; (i) imported for the sole purpose of public exhibit by a public sector body, (ii) title to the property is not intended to pass and does not pass to a person in Canada during the period of time that the property is in Canada, and. (c) The value of carrier media on which software is stored and that is imported in circumstances where, after the importation, tax will be paid or become payable by the importer on the supply in Canada of the right to use that software will be determined as being the value for duty of the carrier media excluding the value of the software, but including the cost of storing the software on it. Customs duties include duties imposed under the Customs Tariff as well as duties imposed under the Special Import Measures Act, i.e., anti-dumping and countervail duties. 61. 3. Taking the above example of an L/C opened for Rs. Documents against Payment (DIP) Bill: If the bill of exchange specifies that all documents pertaining to the goods will be handed over to the importer only when he pays the amount mentioned in the bill, it is called a D/P bill. If the goods are duty free, no import duty is to be paid at the custom office. 62. 28. When an exporter draws a bill of exchange on an importer, and the bill is accepted by the importer’s bank, it is called a Banker’s Acceptance. This provision allows for these conveyances to enter Canada without incurring a duty or tax liability. 44. The L/C limit gets renewed after payment is released by the issuing bank. The bank’s advantage from a revolving L/C is that it will not have to incur costs (and therefore has cost savings) on making changes (called ‘amendments’) in a non-revolving L/C.
